These Terms of Service ("Terms") are an agreement between you and BrightSite. By creating an account or using our website builder and hosting platform.("Service"), you agree to these Terms and our Privacy Policy.
What the Service Does
BrightSite provides a website builder and hosting platform that allows you to create, manage, and publish websites. The Service includes a visual page editor, content management system, blog management, form builder, media storage, custom domain support with SSL certificates, and anonymous visitor analytics.
BrightSite is a platform for building and hosting websites. We do not create content on your behalf, and we do not guarantee any particular outcome from using the Service.
Your Account
You must be at least 13 years of age to use BrightSite. If you are using BrightSite on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Providing accurate and current account information
- Notifying us immediately of any unauthorized access
Acceptable Use
BrightSite is for building legitimate websites. You agree not to use the Service to:
- ✕Host, distribute, or link to content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- ✕Distribute malware, viruses, or other harmful code
- ✕Send spam or unsolicited communications
- ✕Infringe on the intellectual property rights of others
- ✕Engage in phishing, fraud, or deceptive practices
- ✕Attempt to gain unauthorized access to our systems or other users' accounts
- ✕Use the Service in any way that could damage, disable, or impair our infrastructure
- ✕Host content that exploits minors in any way
We reserve the right to remove content and suspend accounts that violate this policy, with or without notice, and without refund.
Intellectual Property
Your Content
You retain full ownership of all content you create, upload, or publish through BrightSite. By using our Service, you grant us a limited license to host, store, display, and serve your content solely for the purpose of operating the Service.
Our Platform
BrightSite, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
Payment & Billing
Paid plans are billed on a recurring basis through Stripe.
Automatic Billing
Plans renew automatically at the end of each billing cycle unless you cancel.
Cancel Anytime
No long-term contracts. Cancellation takes effect at the end of your current period.
Upgrade or Downgrade
Change plans at any time. Changes apply on your next billing cycle.
No Partial Refunds
We do not provide refunds for partial billing periods, except where required by law.
We reserve the right to change pricing with 30 days' advance notice. Price changes will apply at the start of your next billing cycle.
Service Availability
We strive to maintain high availability, but we do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, and unplanned outages may occur.
Service Changes
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Termination
You may close your account at any time. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees.

Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, BrightSite and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunities, arising from your use of or inability to use the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless BrightSite and its officers, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
Dispute Resolution
All disputes arising from these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Delaware or another mutually agreed location.
Class action waiver: You agree that any disputes will be resolved on an individual basis. You waive the right to participate in a class action or class-wide arbitration.
You may opt out of arbitration by sending written notice to support@onbrightsite.com within 30 days of accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal actions not subject to arbitration must be brought in Delaware state or federal courts.
Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you by email or through the platform before they take effect. For minor clarifications, we will just update this page. Continued use of BrightSite after changes constitutes acceptance of the revised Terms.
